Authla Privacy & Terms

This is an agreement between the app known as Authla, referred to in this document as “The App”, which is owned by Villegas Ventures LLC, referred to in this document as “The Owner", and the user in Authla, referred to in this document as “The User”. In this document the words “The Account” is used to reference the Tesla, Inc. account that The User has with Tesla, Inc. In this document Tesla, Inc. may be referred to as “Tesla”. This document shall be followed by all parties where applicable under US and/or local law.

The App, and thus The Owner do not share user data with any third party entities except to verify and/or process necessary information and/or data with Tesla and their API.

Account data, such as an access token and refresh token, may be saved to the user’s device via Apple’s secure Keychain technology. When the user revokes their token, this data will be erased.

For the purposes of this document, Watchla is hereby acknowledged as a separate app owned by the Owner, but part of the same ecosystem as Authla. If the User decides to use Authla to sign in to Watchla, Authla may use the User’s secure private iCloud database specific to Authla and their iCloud enabled devices to transmit the necessary data to serve the sign in to Watchla. If the User opts to Sign out of Watchla from Authla, this data may be erased from said systems. If User revokes their token, this data will certainly be erased.

Data collection: Authla does not collect any data. In fact no data stored by Authla can be seen by anyone (including the Owner), except for the User. No sensitive data from Authla can be accessed outside of the User’s iCloud device ecosystem. It is impossible, by the code-level structure set forth in Authla.

Data protection: If the User opts for biometric security on Authla and their device is capable of biometric authentication, the Authla app on that device for which the user opted will be protected by biometric authentication. This means that in-order to access any data from the app, the authorized person must pass a biometric authentication. Biometric authentication will be administered via Apple’s secure Face ID or Touch ID.

In the event that Tesla servers or The App itself or the communications between Tesla and The App is breached, intercepted or other, The User agrees and understands here forth per this agreement that they cannot hold The App or The Owner liable in anyway, shape or form, and Releases both The Owner and The App of any liability where applicable under US and/or local law. The User understands that they use The App completely at their own risk.

This document shall be followed by all parties where applicable under US and international law.

The User agrees to use The App in good-faith and without malicious intent. Any “hacking”, manipulation, or cloning of The App by The User, especially to harm or disenfranchise other users, The App or The Owner, or Tesla is strictly prohibited and will result in a monetary penalty not below 250,000 United States Dollars to be paid by The User to The Owner not more than 30 days after the monetary penalty is issued.

If The User uses The App to enter or gain access to a Tesla account that The User doesn’t have access to and/or does not have permission to access by the respective owner of said account, The User may face all recourse and penalties under the scope of US and international law and will be issued a monetary penalty not below 50,000 United States Dollars to be paid by The User to The Owner not more than 30 days after the monetary penalty is issued.

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
